PLEASE READ OUR TERMS AND CONDITIONS OF SALE CAREFULLY WHICH GOVERN ALL PURCHASES OF GOODS FROM THIS WEBSITE:

These are the terms and conditions that apply to all purchases of products from the Baby Bare Company Ltd via this web site. From time to time these terms will be updated so please check them before making a new purchase.

Our customers are the foundation of our business and we aim to exceed all expectations. Baby Bare takes great pride in the exceptional workmanship and quality of our gifts, and the reliability of our service.Personalizing Your Gift

When personalizing any goods, we shall use the utmost care and skill in doing so. It is therefore paramount that you take as much care as possible in giving us your personalization instructions. We cannot accept liability for incorrectly personalized items if your instructions were not reasonably clear.


Order acceptance


By placing your order with us, you agree to buy the goods ordered at the specified price. If you have any doubts at all about the quality or suitability of a personalized item, we advise that you do not place the order without contacting our sales office first. All our gifts are offered subject to availability, occasionally some items may be replaced with a similar high quality product with the same or greater value. In the very rare circumstance that a product price has increased between the time of your order and our acceptance of it or, even more rarely if a delivery charge needs to be applied or amended, we will email you to advise of the change. We will never charge your card with an additional amount unless we have your written prior consent. Occasionally errors creep into the catalogue (and on the Web-site), and we ask that you check prices and specifications before placing your order if you are in any doubt whatsoever.


Order Changes/Cancellation


If you ask us to alter your personalization after the order has been received, we will make our best efforts to do so, we are committed to fulfilling orders quickly and efficiently, and therefore cannot guarantee any changes as it depends on how far the order has progressed. Sometimes this may result in an increased cost, which we promise to advise you of before going ahead with any changes in personalization on your behalf. If you do wish to make any changes please call our customer service representatives on 01268 799085 for further advise.

If, after you have placed an order, you wish to cancel it, we may consider doing so (although this at our discretion) but this may be subject to you paying us a handling charge. Unfortunately, we cannot accept cancellations on personalised goods after work has commenced on the personalisation neither can personalised items be returned for a full refund, (as they have no resale value), if you have any doubts at all about the quality or suitability of a personalised item, we advise that you do not place the order without contacting our sales office first.


Methods of Payment


Baby Bare accepts the following credit and debit cards: American Express, Visa, Mastercard, JCB, Solo and Switch.

Or Cheques made payable to Baby Bare Company Limited, we allow 4 days for your cheque to clear prior to your order being processed.


Payment


If you decide to pay by credit or debit card, it will be authorized at the time you place the order - this therefore means you will be advised instantly whether your order has been successful, and removes the need for us (or anyone) to see your card details, which reduces potential fraud even further. By selecting the "Confirm Order" button you hereby accept that you are instructing us to charge your credit/debit card the amount due to us as shown in your electronic order form in the "TOTAL". You undertake that all details you provide to us for the purposes of purchasing products are correct, that the credit/debit card you are using is your own and that there are sufficient funds to cover the costs of the products. EPDQ provide a secure link for your transaction details. As we are not responsible for the operation of this secure link we will not, unless we are negligent, be liable for any loss you may suffer if a third party obtains unauthorised access to any information you provide via this link. If products are not available for any reason after we have accepted your order, we will let you know and will refund any amounts already paid by way of a credit to your credit card/ debit card account.

Once you have filled in your payment details and clicked the submit button, your order will be sent to us. As soon as we receive your order, and your credit/ debit card details have been accepted, we will send you an Email, confirming your order. This e-mail will serve as your receipt of payment; therefore we recommend that you print this e-mail for future reference.

If there is a query on your order, we will make contact with you either by telephone or e-mail, so please ensure that these are entered on the billing details form.Security

Our secure server software ( SSL) is the industry standard and is among the best software available today for secure commerce transactions. All credit card numbers and personal details are encrypted in the software when the order is placed using 128-bit encryption and as the information travels over the Internet this information cannot be read. They are only decrypted after they reach our computer.

No "Quibble" Guarantee


We know you will be delighted with anything you purchase from Baby Bare. However, if you are not satisfied and we are satisfied that you have good reason to be dissatisfied, and that you notify us (preferably in writing) of your dissatisfaction within 14 days of receipt of the goods, we will be happy to replace them for you or to refund your money.

Liabilities

Baby Bare will attempt to ensure that the information available on our website at any one time is accurate, but cannot guarantee that it will be fault-free. Our website is provided on a "as is" and "as available" basis. We do not make any warranties that the website is secure or is free from infection by viruses or anything else that has contaminated or disruptive properties. We do not accept liability for any errors and omissions and reserve the right to change information, prices and descriptions of listed goods at any time. From time to time certain products may vary in style and material to that shown on the website.

All warranties, express or implied, with respect to this web site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose are hereby excluded to the fullest extent permitted by law. This does not affect your statutory rights.


Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the supply of products or contemplated supply shall be limited to the total price of the products purchased in respect of any claims. We will not be liable for any indirect or consequential loss (whether for loss of profits, loss of business, depletion of goodwill or otherwise) or damage of any kind in contract, tort or otherwise arising out of the use of the website or use of the products or services. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation.


We reserve the right to defer the delivery date or cancel the order or reduce the volume of the ordered products without liability to you if we are prevented from or delayed in the carrying out of our business due to circumstances beyond our reasonable control.


Responsibility for local taxes and duties


When we ship goods for delivery outside the United Kingdom , the recipient is liable for any local taxes or import duties that may be payable.


Delivery


If we have agreed to deliver your goods, you will become responsible for the goods as soon as we have delivered them to you. If we use a third party carrier (e.g. The Royal Mail) to deliver them, we shall be liable for damage or shortfall up to the point of delivery to you, provided that: -

a. The damage or shortfall is notified to us or to the carrier (preferably in writing) within 10 days of delivery

b. (If the goods have not been delivered at all) you notify us or the carrier (preferably in writing) within 10 days of the scheduled delivery date

This does not affect your statutory rights as a consumer.

Whenever we become aware that goods will take longer than the estimated delivery time, we will contact you to give you the revised estimated delivery date. As long as the goods are not items which have already been personalized we will give you the option of continuing to wait for the item, or to accept a full refund for the item in question.

There are several reasons for this, but largely it is to do with:-

1. The unpredictability of the Postal and Courier Services, and

2. The sheer volume of orders being handled at any specific period during the year - in the pre-Christmas period there will always be pressure on us and our suppliers to achieve our target delivery dates.


In our brochure and on our website we clearly state the estimated delivery time on individual product ranges. Most items are usually delivered well within this timeframe. We always strive to ensure that delivery is achieved. We cannot accept orders contingent upon a delivery date prior to these stated timeframes. Where a delivery date is specified as critical, we can only offer to do our utmost to meet that delivery date, but this does not constitute a guarantee. As a result of this you the customer must decide whether you wish to proceed with the order on this basis.
